Emissions Compliance Advisory
Palenon Performance no longer sells performance parts in California that do not meet CARB (California Air Resources Board) approval. Customers who previously purchased competition-use-only, non-CARB-compliant parts can refer to the guidelines below. If you have further questions, please contact us at sales@palenonperformance.com.
Shipping Restrictions
Products labeled "Competition Only" cannot be shipped to addresses within California.
Product Information
Palenon Performance offers both replacement parts and competition-use-only performance parts. Components marked as competition-use-only are clearly labeled on product listings and are intended strictly for use under specific guidelines outlined below.
California enforces stringent rules on aftermarket parts that could affect vehicle emissions. In general, emissions-related aftermarket parts cannot be sold or used unless they:
- Qualify as a "Replacement Part" under California law, or
- Have been authorized through an Executive Order (EO) issued by CARB.
CARB Aftermarket Part Categories
CARB classifies emissions-related aftermarket parts into three categories:
-
Replacement Parts
- These parts are designed to function equivalently to the original equipment manufacturer (OEM) components and do not impact vehicle emissions.
-
Examples:
- If the vehicle’s stock exhaust system lacks a catalytic converter, aftermarket parts may qualify as replacement parts provided they do not interfere with emissions-control devices, such as oxygen sensors.
- If the stock system includes a catalytic converter, aftermarket mufflers positioned downstream (cat-back systems) qualify as replacement parts if they do not interfere with emissions-control equipment.
-
Executive Order (EO) Parts
- These components are approved by CARB through a formal evaluation process that ensures they do not adversely affect emissions. CARB grants such parts an Executive Order (EO) certification for legal sale and use on specific vehicles.
- Example: Any part that replaces or modifies emissions-control devices, such as catalytic converters, must have an EO for legal use on public roads.
-
Competition-Use-Only Parts
- These parts interfere with or replace emissions-control systems, such as catalytic converters or oxygen sensors, and are legal only for vehicles used exclusively in sanctioned racing events on closed courses.
-
Legal Use Limitations:
- Competition-use-only parts are prohibited for use on vehicles operated on public roads, even for transportation to race events. Vehicles equipped with such parts must be transported to events via trailer or similar means.
- California defines a "racing vehicle" as one used solely for competition and not operated on public highways (Calif. Health & Safety Code § 39048).
Compliance Obligations
Competition-use-only parts are strictly limited to racing vehicles used in closed-course events. Using these parts on public roads or non-competition vehicles is against federal and state regulations and may result in fines, penalties, and voiding of warranties from both Palenon performance and the vehicle manufacturer.
Customers are responsible for ensuring compliance with all applicable laws. Palenon Performance disclaims any liability for misuse or failure to follow these legal requirements.
